Texas just took a major step forward in supporting medical cannabis patients. In a rare moment of bipartisan unity, both chambers of the state legislature passed a compromise bill that significantly expands the Texas Compassionate Use Program (TCUP). This is huge news for current and prospective patients in Texas, many of whom have waited years for meaningful reform.

What the New Medical Cannabis Law Covers

The newly passed bill expands eligibility, product options, and licensing capacity under TCUP. Here’s what the legislation includes:

  • New Qualifying Conditions: Patients suffering from chronic pain, traumatic brain injury (TBI), Crohn’s disease, and other inflammatory bowel diseases are now eligible. In addition, anyone receiving end-of-life or palliative care automatically qualifies.
  • Expanded Product Access: The bill authorizes a broader range of cannabis products, including patches, topicals, suppositories, inhalers, nebulizers, and vape devices. These options give patients more flexibility and dignity in their care routines.
  • More Licensed Providers: The number of licensed medical marijuana businesses will increase from just three to fifteen, with providers now allowed to operate satellite locations. This is expected to reduce patient wait times and improve access in rural and underserved areas.

 

How We Got Here: A Legislative Tug-of-War

The road to this bill wasn’t smooth. The Texas House passed their version of the expansion bill (HB 46) on May 13. The Senate approved an amended version on May 27, but the House declined those changes. A conference committee worked over the weekend to finalize a compromise, which passed on Sunday with overwhelming support: 138-1 in the House and a unanimous 31-0 in the Senate.

Rep. Tony Tinderholt, a Republican who served on the committee, praised the final bill, noting that it included key coverage for veterans and chronic pain patients. “Veterans are covered, chronic pain is covered, and this bill will cover all of the things that we wanted,” he said.

Why This Is a Game-Changer for Texas Medical Cannabis Patients

For years, Texas’ medical marijuana program has been one of the most restrictive in the country. Many patients with debilitating conditions were excluded simply because their diagnoses didn’t appear on the short qualifying list.

With this expansion, thousands more Texans will be able to access cannabis as part of their treatment plans. For veterans, people living with chronic pain, and patients in palliative care, this is more than policy – it’s a lifeline.

Patients will also benefit from increased convenience. With new product forms and more dispensary locations, they’ll have easier access to tailored treatment options that work for their lifestyle and medical needs.

What Happens Next?

The bill now heads to Governor Greg Abbott’s desk for consideration. Given the broad bipartisan support, many advocates expect him to sign it into law.

If approved, the Department of Public Safety will begin issuing additional business licenses and updating its list of qualifying conditions. Patients should expect expanded access to begin rolling out later this year or early next.

But Not All News Is Good News

Just days before this progress, Texas lawmakers passed SB 3—a bill that bans consumable hemp products containing any THC, even if they comply with the federal legal limit of 0.3%. This has caused confusion and concern, especially among patients who rely on hemp-derived alternatives for relief.

As Peter Barsoom, founder of cannabis brand 1906, noted in an interview with Forbes: “Texas is sending a mixed message.” On one hand, lawmakers are acknowledging the medical value of cannabis; on the other, they’re limiting access to legally compliant hemp products. Advocates have called on the governor to veto SB 3, but its fate remains unclear.
